1. Object and scope of application
These General Conditions govern the online sale of Sartoria Pugilistica® brand products via the official website.
By placing an order, you agree to the full and unreserved acceptance of these conditions.
The conditions prevail over any general conditions of the buyer.
2. Artisanal nature of the products
Sartoria Pugilistica® products are handcrafted.
Any changes to:
hue
skin texture
trim
stitching
minimal aesthetic alignments
decorative details
They are intrinsic characteristics of manual workmanship and cannot be considered defects or non-conformities.
The images on the site are for illustrative purposes only.
3. Product types
3.1 Standard products
Models with predefined and non-modifiable technical and aesthetic characteristics.
3.2 Customized / tailor-made products
Products made according to specific customer requests.
For these products:
the right of withdrawal is excluded
no refunds are allowed
No changes are permitted after project approval
Pursuant to Article 59, letter c, of the Consumer Code, the right of withdrawal is excluded for goods made to measure or clearly personalized.
The customer guarantees that he or she holds the rights to any logos, trademarks, or content provided and fully indemnifies the Company from any claims by third parties.
4. Conclusion of the contract
The contract is considered concluded upon confirmation of the order and receipt of payment.
The Company reserves the right to refuse orders in the following cases:
unavailability of materials
incomplete or incorrect data
suspected fraudulent use
technical incompatibility of the request
5. Prices and payments
All prices shown on the site include VAT.
Accepted payment methods:
Stripe
PayPal
Bank transfer
Payment is required in a single solution, unless otherwise agreed in writing.
6. Shipping and transfer of risk
Available couriers are indicated at checkout or agreed upon with the customer.
Unless otherwise agreed in writing, delivery is intended:
EXW Cagliari – Incoterms® 2020.
The risk passes to the customer upon delivery to the carrier.
Any customs duties, taxes, or import costs for shipments outside the EU are the sole responsibility of the customer.
7. Delivery terms
Production times for customized products are indicative and may vary depending on:
material availability
technical complexity
processing loads
Delay does not constitute non-fulfilment except in the case of fraud or gross negligence.
8. Returns and refunds
For standard, non-customized products:
The return request must be sent within 8 days of delivery
must be accompanied by photographic documentation
shipping costs are charged to the customer
Refunds are not provided for products that comply with the description and declared craftsmanship.
There is no right of withdrawal or refund for personalized or made-to-measure products.
9. Repairs
The Company reserves a maximum period of 60 days for any repairs or technical checks.
10. Warranty
The warranty covers only structural manufacturing defects.
Are excluded:
normal wear
deterioration due to use
damage from improper use
non-compliant use
changes made by the customer
approved customizations
11. Intended use
Sartoria Pugilistica® products:
are not personal protective equipment (PPE). Are not certified as protective equipment. Are intended for controlled technical or exhibition use. Use is prohibited for minors under 18 years of age.
12. Limitation of liability
The Company is not liable for:
direct or indirect damages
personal injuries
economic losses
improper use
use not in accordance with the intended purpose
The customer agrees to indemnify the Company from any liability arising from the non-compliant use of the products.
The Company's maximum liability is limited to the value of the product purchased.
13. Intellectual property
The Sartoria Pugilistica® brand, logos, designs, images, and content are protected by national and international law.
Any unauthorized reproduction is prohibited.
14. Privacy
The processing of personal data takes place in compliance with EU Regulation 2016/679 (GDPR).

15. Applicable law
These conditions are governed by Italian law.
16. Competent court
The Court of Cagliari has exclusive jurisdiction over any dispute.
Consumer protection remains intact within the mandatory limits established by applicable legislation.
17. Unfair terms
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the customer declares to expressly approve the following clauses:

18. Transport damage
The products are delivered EXW Cagliari – Incoterms® 2020.
The risk relating to transportation is transferred to the customer upon delivery to the carrier.
Any damage occurring during transport is attributable to the carrier in charge.
The customer is required to:
check the integrity of the package upon delivery
accept the package with specific reservations in case of damaged packaging
document any anomalies with photographs
report the damage within 24 hours of delivery to the address info@sartoriapugilistica.com
In the absence of a written reservation at the time of delivery and timely communication, it will not be possible to activate any complaints procedure.
The Company may, at its sole discretion and without acknowledging liability, assist the customer in managing the matter with the carrier.
